House of Janneke GmbH operates this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the “Services”). House of Janneke GmbH is powered by Shopify, which enables us to provide the Services to you.

The terms and conditions below, together with any policies referenced herein (these “Terms of Service” or “Terms”), describe your rights and responsibilities when you use the Services.

We have made every effort to show our products accurately in our online store. However, colours and product appearance may differ slightly from how they look on your screen, depending on your device and its settings.

Product descriptions may change over time. We reserve the right to discontinue any product at any time and may limit the quantities of any product that we offer to any person or region.

SECTION 3 - ORDERS

The product pages in our online store are not a binding offer. When you place an order, you are making an offer to purchase. A contract is formed when House of Janneke GmbH confirms acceptance of your order, at the latest when we ship the goods. We must receive your payment before your order is accepted. In the event that we do not accept, make a change to, or cancel an order, we will notify you using the email address, billing address and/or phone number provided with the order, and refund any payment already made.

Returns and exchanges are handled in accordance with our Refund Policy. If you are a consumer, your statutory right of withdrawal remains unaffected.

Our online store is intended for personal and household purchases. For wholesale orders, please contact us.

SECTION 4 - PRICES AND BILLING

Prices, discounts and promotions are subject to change. The price charged for a product will be the price in effect at the time the order is placed and will be set out in your order confirmation email. All prices include the applicable VAT. Shipping costs are shown at checkout before you pay; for orders outside the EU, see our Shipping Policy regarding customs and import charges.

We may offer promotions from time to time that are governed by separate terms and conditions. If there is a conflict between the terms of a promotion and these Terms, the promotion terms will govern.

You agree to provide current, complete and accurate purchase, payment and account information for all purchases made in our store, and to keep this information up to date so that we can complete your transactions and contact you as needed.

SECTION 5 - SHIPPING AND DELIVERY

All delivery times are estimates. We are not responsible for delays caused by shipping carriers, customs processing or events outside our control. If you are a consumer, the risk of loss or damage passes to you when the goods are delivered to you or to a person you have named. If you are a business customer, the risk passes to you when we hand the goods to the carrier.

House of Janneke’s names, logos, product names, designs and slogans are trademarks of House of Janneke GmbH or its affiliates or licensors. You must not use them without our prior written permission. Shopify’s name, logo, product and service names, designs and slogans are trademarks of Shopify. All other names, logos, product and service names, designs and slogans on the Services are the trademarks of their respective owners.

SECTION 7 - OPTIONAL TOOLS

You may be given access to tools offered by third parties as part of the Services, which we do not monitor and have no control over. We provide access to such tools “as is” and without any endorsement. Any use of these optional tools is at your own discretion, and you should make sure you are familiar with the terms on which they are provided by the relevant third party.

We may offer new features through the Services in the future. Such new features are also part of the Services and subject to these Terms of Service.

SECTION 9 - RELATIONSHIP WITH SHOPIFY

House of Janneke GmbH is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with House of Janneke GmbH. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and House of Janneke GmbH, including any injury, damage or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages and liabilities arising from or related to your purchases and transactions with House of Janneke GmbH.

We may, but are not obliged to, monitor, edit or remove Feedback that we consider unlawful, offensive or in breach of these Terms.

Occasionally, information in the Services may contain typographical errors, inaccuracies or omissions relating to product descriptions, prices, promotions, shipping charges, transit times or availability. We reserve the right to correct any errors, inaccuracies or omissions and to change or update information at any time. If an obvious error affects an order you have already placed, we will contact you before processing it, and you may cancel the order free of charge.

You may use the Services for lawful purposes only. In particular, you may not use the Services to violate any applicable law, to infringe our intellectual property rights or those of others, to harass or harm any person, to transmit false or misleading information, to send spam or unsolicited advertising, or to impersonate any other person.

SECTION 14 - TERMINATION

We may terminate these Terms or your access to the Services at any time for good cause. Orders that have already been accepted are not affected. The sections on Intellectual Property, Feedback, Liability and Governing Law continue to apply after termination.

SECTION 15 - WARRANTY

The information presented on the Services is for general information purposes. Your statutory warranty rights for the products you buy from us apply in full. If a product is faulty or damaged, please contact us as described in our Refund Policy.

SECTION 16 - LIMITATION OF LIABILITY

We are liable without limitation for damage caused intentionally or through gross negligence, for injury to life, body or health, under the Product Liability Act and where we have given a guarantee. In cases of slight negligence, we are only liable for the breach of essential contractual obligations, and our liability is limited to the typical, foreseeable damage. Otherwise, our liability is excluded. These limitations also apply to our employees, agents and partners, including Shopify.

SECTION 17 - INDEMNIFICATION

If you breach these Terms or violate any law or the rights of a third party through your use of the Services, and a third party brings a claim against us as a result, you agree to indemnify us against that claim, including reasonable legal costs, provided that you are responsible for the breach.

SECTION 18 - SEVERABILITY

If any provision of these Terms of Service is found to be invalid or unenforceable, the remaining provisions remain valid.

SECTION 19 - ENTIRE AGREEMENT

These Terms of Service and any policies posted by us on this site form the entire agreement between you and us regarding your use of the Services and replace any earlier versions of these Terms.

SECTION 20 - ASSIGNMENT

You may not transfer or assign your rights or obligations under these Terms without our prior written consent.

SECTION 21 - GOVERNING LAW

These Terms of Service and all contracts concluded through the Services are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer, this choice of law does not deprive you of the protection of the mandatory provisions of the law of the country in which you live. We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.
